Speeding ticket help

I got a 90 in a 50 today and the cop wrote my address wrong on the ticket he wrote Bradford instead of Brampton, Can I use that to get off and how many points is it.

Probably not, unfortunately. I once had a cop list me as a "youth" on a ticket, when I was not. I talked to a woman at police HQ about getting it nulled.
She told me that it wasn't serious enough of an error to throw out the ticket, and it would be hard for a traffic pig to REALLY mess up a ticket enough that it could be thrown out.
I'm no lawyer, tho.

i had the cop make a mistake once on my ticket. i took the ticket to points and they told me that it would sick. and that the juge would just say "it was you that was speeding because you are holding the ticket"

its worth a shot to see. 40 over is big time $$$

If the cop took your license then your still gonna get the ticket. All they have to do is look back at the ticket.

i have had friends get out of stuff like this because of an error in ticket writing. not getting the town correct is quite the error. i would try to get out of it paul.

fight it, no matter what the ticket says, right/wrong, 90% of the time the cop doesn't show up so they throw it out.

he is soooo right...

i fight every ticket i get..i went to school to become a cop..and i still may pursue this..

if there is anything wrong with how the ticket is filled out..you "may" get out of it.. you have to go to the jp(justice of the peace) and talk with them...

I think the 90% thing may be a little high.

Hughes, i'd really consult someone that knows what they're talking about. I've heard of people fighting tickets only to have fines raised and charges added. It probably won't happen to you but better safe than sorry.

Don't we have a couple of police officers on the board? It's probably poor etiquette for them to offer advice though

Like Acceld said...I know it cost money for there services Paul, but this is a worthwhile case to take to something like X-Coppers or one of those guys. 40 over would be about a $300 and of course the black mark on your insurance. I'd rather pay $300 for their services and get the ticket dismissed. But if all they can get it is reduced than it's not worth it. But talk to one of those companies first.

I'm assuming that because he lives in Brampton, he got the ticket in Brampton. That being said- most of the time the cops in Brampton DO show up for the court dates. I'm not sure if this was some policy they brought out last year- but maybe too many people were walking because of no officer(s) showing up. Of course, most of the traffic cops in Brampton are on the young-ish side, so they may be trying to collect brownie points or something.

That being said- last time I heard (about 4 years ago now) 40 km/h-over was good for $300.00 and 4 points- certainly not a ball-breaker, but that's without taking insurance company issues into account.

I'm sure it can be plead down- why not go in, plead not quilty in order to get a meeting with the crown (they ask you this automatically before setting a trial date) to discuss the issue. DO NOT plead "guilty" in any manner, i.e. Don't plead "guilty with an explanation" or you've lost any possible ability to negotiate anything. You can also pay the X-Copper or POINTTS places- I think they run in the $300-$400 range for basic tickets- but will not gurantee anything.

I was caught doing 140 in a 90 zone 2 years ago. I took it to court and got the charge brought down to 110 in a 90 with something like 2 points and a fine. I just talked to the prosecutor before hand (like 5 mins before the judge saw me) and gave her a story about what happened that night and she said I can knock it to here for you. considering the cop WAS THERE and could have had me nailed for the full charge if she pleased, you gotta remember when it comes down to it they are people and you can play on their sympathies.

With the help of x-copper or something, you maybe able to get it beat even with them arranging the cops not showing up and the case tossed.

i would do anything to get that ticket thrown out, dismissed or what ever. you think your insurance is high, then realize this, it will probably double, if not real close to double thats if they insure you agian...... take it to court go to who ever but i would do somethin about it yesterday (pronto)

I got the ticket in Bradford and he wrote my address as Bradford not Brampton and Thursday I go to see the lawyer about it. The guy I am going to see got my friend off some real bad tickets. My insurancre has to be renewed next month so if I fight it it will hold it off my record until after I renew the policy.
